Alabama: Three Pro-Gun Bills Expected to be Heard Soon!
As the 2009 session continues to progress in Montgomery, three pro-gun bills will be taken up as early as this week:
House Bill 362, sponsored by State Representative Craig Ford (D-28), passed the House Commerce Committee by a unanimous vote a few weeks ago, but not before an anti-gun amendment was attached. HB362 is now expected to be heard by the full House on Thursday, April 16.
HB362, as originally written, would protect your right to lawfully transport and store firearms in a privately-owned and locked motor vehicle while parked in publicly accessible parking lots controlled by your employer or a business you frequent.
As previously reported, an exemption for railroad companies was attached. This amendment will infringe on the Second Amendment rights of railroad employees at the workplace.
In February, the Tenth Circuit U.S. Court of Appeals upheld an Oklahoma statute that protects the right of employees to store firearms in locked vehicles in publicly accessible parking lots. The proposed Alabama bill is very similar to the Oklahoma law and should withstand any similar challenges that might be launched.
Please contact your State Representative TODAY and respectfully urge them to remove the railroad exemption and to oppose any further proposed exemptions when they meet on Thursday, April 16. Contact information can be found here.
Senate Bill 296, sponsored by State Senator Scott Beason (R-17), would protect our Second Amendment rights by prohibiting any government agency from confiscating firearms or regulating the lawful sale, possession, transfer, transport and carry of firearms during a state of emergency. SB 296 is expected to be voted on by the House Judiciary Committee. SB 296 passed the full Senate unanimously in early March.
House Bill 432 passed out of the House in early March and is expecting action in the Senate Judiciary Committee soon. Sponsored by State Representative Jack Page (D-29), HB432 would make all records pertaining to pistol permits confidential, only to be used for law enforcement purposes. Any public disclosure of this information would be a Class A misdemeanor.
