"Montana-made guns may form the basis for a court showdown over states' rights if the governor signs a bill to release some firearms in the state from federal regulation.

The proposed law aims to exempt firearms, weapons components and ammunition made in Montana and kept in Montana from federal gun laws. Since the state has few gun laws of its own, the legislation would allow some gunowners and sellers in the state to skirt registration, licensing requirements and background checks entirely."

I have been following this and think they could run into some problems. The "key" is that ALL parts must be from Montana. That includes the steel etc..... If even a single part crosses state lines they are under federal jurisdiction.

Does Montana have a registry? I would be surprised if they did........ after all it is Montana.

The states constitution actually allows it to break off on its own if guns are outlawed. :)

I think the legislators are very well aware of how broadly the federal government applies the commerce clause. I think they're doing this solely to force a scotus case and attempt to establish a different application of the commerce clause.

I think you hit the nail on the head. They are going to try and challenge this in court. Look at how California thumbs its nose at the feds......

States rights is the emphasis made by Montana's legislature. I have advocated States Rights, especially since the passing of the The 1974 Emergency Highway Energy Conservation Act. which prohibited speed limits higher than 55 mph (90 km/h). What got my goat was the fact that Law Enforcement was made to hold down the average speed or the State would lose it's share of Federal Highway funding. In other words the Federal Government was dictating law enforcement deployment, throughout the 50 States. In the end, the savings in gas was estimated to be between 1/2 to a high of 1%. In the same time period, crime made a dramatic rise.

Kudos to Montana! However,the bill awaits the signature of a Governor who happens to be a Democrat!
