I know the idiots passed a law limiting us to 10 rounds a long time ago, but what about pre-ban guns? Is it enough to buy a pre-ban magazine or does the whole enchilada have to be pre-ban? :butthead: I'll probably get either a Kimber SIS or a STI Trojan 5.0 for a first 1911 but in the miraculous event I get CCW I would LIKE to be able to carry either a P-14-45 or an STI High Cap 1911. Any thoughts?

Welcome to the forums! :wc: I'm not familiar with New York state laws, but I will repeat what OD* tells me when we speak about firearm laws in Illinois, where I live, "Move to a free state".

I would probably ask an attorney that question, they will know. But make sure it's a criminal attorney, they deal with firearm laws regularly. You could ask a police officer, but they might not know the specifics of the law and you are the one that is responsible for your actions if they tell you something that turns out to be incorrect.

I am a fan of Mrs. Thatcher. The young Bush would take a tough road and his Father wouldn't. Although the older Bush was a hero as was John McCain in a time of war, they didn't have strength in their convictions politically, they were both all too willing to compromise. I liked General Powell until I found out more about him. Claimed to be a conservative and voted for Jimmy Carter? The more you find out, the more tarnished his star became. He regularly bit the hands that elevated him to 4 star general and Secretary of State.

Back to the subject at hand, the New York law, while I must admit I am unfamiliar with it, I suspect that if you saw a 10 round magazine ban on the books, I'm sure if you read further, it will state that no matter when it was manufactured, it is illegal in that state to own a magazine or firearm that holds more than 10 rounds.

they'd grandfather in the older mags but then the purpose of ANY NY State gun law is NOT to be fair, NOT to punish or inconvenience criminals but to harass and discourage LEGITIMATE LAW ABIDING citizens. :butthead:

They ARE the NRA in NY and their legal beagle says that the law is SO convoluted that even the people who wrote it can't agree on what it means!!! He is fairly certain that if I buy PRE-ban mags from a NY dealer they can't say squat, at least not at home or on a range. :eb:

What does the law say? There ARE NO 10-round, pre-ban Para-Ordnance magazines, except for the P10.45 midget pistol. Para started producing pistols with 10-round magazines in response to the Federal AWB. There are a few states other than NY that still have some version of AWB in force ... California is one. Para still sells 10-round versions of many of their pistols to satisfy those states.

If the NY law is a capacity limiting law, buying pre-ban magazines won't help unless the law specifically exempts "grandfathered" products. If there's no grandfather provision, or if it isn't crystal clear, IMHO you would be much safer (legally) to buy a new 10-round model.

I am not an ABA-certified paralegal for nothing! I had to dig a little. The NY State Penal Law (Section 265(23) bans any magazine or feeding device that can hold more than ten rounds of ammuntion IF manufactured AFTER September 13th, 1994. IF there is a serial number on the mag and IF Para can verify IN WRITING that it was made before the ban I think I'm on solid ground. But being a para I have to run that past the lawyer since otherwise even advising myself could be UPL (Unlicensed Practice of Law). Weird laws huh?

After reading the forums and all the bellyaching about EVERY company out there I may just stick with a straight up 1911 like the STI Trojan, Kimber Eclipse or a Para single stack. I guess I should NOT mess with what ain't broken and avoid the pitfalls of gun hating pols?

You would have to verify with Para-Ordnance, but my understanding is that when they stopped making normal capacity magazines due to the 1994 Federal AWB, they switched from painted steel to either nickel plated or stainless (not sure which) tubes. When they started making full capacity magazines again after the AWB expired, they stayed with the [shiny metal].

If that's correct, any painted, black Para-Ordnance high-capacity magazine is pre-ban. I believe you can verify this on Para's own seb site. Check the magazines for sale, and I think it will show that any black magazines are listed as "pre-ban," and everything else is [shiny metal].

And CDNN is still selling them, at $29 each.
