A larger panel of the 9th Circuit Court Of Appeals will rehear the Nordyke case on Sept 24. If they reverse the original decision there goes the split. Could that spell the end of any chance of SCOTUS hearing the case?

I doubt to a degree that it would matter. The conferences to decide on hearing Maloney v. Cuomo and NRA v. Chicago are already scheduled for late next month. With the split, I'd imagine they would have no choice, but it only takes four votes to accept a case, so if either the liberals or the conservatives, or some combination thereof, think they have a good chance to get a ruling they find favorable, they can certainly still hear them. SCOTUS takes many cases not arising from circuit splits.
