Tomorrow, Friday, May 1st 2009, HB 410 will be listed on the House Intent Calendar to be debated by the full Texas House of Representatives.
HB 410 by Rep. Carl Isett (R-Lubbock) repeals the requirement and the penalty for a CHL when in possession of their handgun and stopped by law enforcement to show their concealed carry license in addition to their personal identification. The penalty a CHL may be given for the first "offense" of not immediately displaying their concealed carry license is a 90 day suspension. A subsequent failure to display may result in being charged with a class B misdemeanor and loss of license.
Passage of HB 410 does not mean that law enforcement goes uninformed, quite the contrary; the requirement is redundant. A common "wants and warrants check" gives law enforcement the information that the person in question is a concealed handgun licensee.
No such requirement or penalty is made of hunters, sport shooters, or others in legal possession of a firearm. Why would we penalize the best of the best!
